These terms of use (the "Terms of Use") govern the use of musubrand.com (the "Site"), published by MUSU, SARL with a share capital of €5,000, RCS Nice 901 778 902, 35 avenue de Profondeville, 06190 Roquebrune-Cap-Martin, France. Purchases on the Site are governed by our Terms of Sale.
Article 1. Access to the Site
1.1. Access to the Site is free, apart from the cost of your internet connection.
1.2. MUSU takes care to keep the Site available but may suspend access, in particular for maintenance. Such interruptions do not affect your orders in progress, which continue to be performed under the Terms of Sale.
Article 2. Customer account
2.1. Creating a customer account is reserved for persons aged 18 or older. You do not need an account to order.
2.2. You agree to provide accurate information and keep it up to date. You are responsible for keeping your login details confidential. If you notice unauthorised use of your account, tell us at team@musubrand.com.
2.3. You may delete your account at any time by writing to team@musubrand.com.
2.4. MUSU may suspend an account in the event of fraudulent use or use contrary to these Terms of Use, after informing you, except in urgent cases.
Article 3. Use of the Site
You agree to use the Site fairly, and in particular not to:
- interfere with its operation or security;
- extract its content or data by automated means;
- use another person's data or a payment method that is not yours.
Article 4. Intellectual property
4.1. The MUSU trademark, logos, frame designs, photographs, videos, texts and, more generally, the content of the Site belong to MUSU or are used with the permission of their owners. They are protected by intellectual property law.
4.2. Any reproduction, display or reuse of this content, in whole or in part, without MUSU's prior written permission is prohibited, except within the limits allowed by law (for example, private use or short quotation).
Article 5. Content you post
If you post a review or other content on the Site, you agree that it is genuine, that it concerns a product you have bought or used, and that it is not unlawful, abusive or defamatory. You may report unlawful content to team@musubrand.com; MUSU removes it promptly once aware of it if it is clearly unlawful.
Article 6. Links
The Site may contain links to third-party sites (social networks, carriers, payment providers). Those sites are the responsibility of their publishers and subject to their own terms.
Article 7. Personal data and cookies
MUSU processes your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act of 6 January 1978. Purposes, retention periods, your rights and cookie management are described in our privacy policy, available on the Site.
Article 8. Liability
8.1. MUSU takes the necessary steps to keep the information on the Site accurate and up to date, and corrects any error reported.
8.2. Nothing in these Terms of Use limits MUSU's liability to a consumer or removes or reduces your right to compensation.
Article 9. Changes to the Terms of Use
MUSU may amend these Terms of Use. The applicable version is the one online when you visit. An amendment does not apply to orders already placed, which remain governed by the Terms of Sale accepted on the day of the order.

10.2. If you are a consumer, you may refer a dispute free of charge to the consumer mediator MUSU belongs to, under the conditions set out in Article 15 of the Terms of Sale.
10.3. These Terms of Use are governed by French law. If you live outside France, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence. In the event of a dispute, if you are a consumer, you may bring proceedings, at your choice, before one of the courts with territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where you lived when the contract was concluded or when the harmful event occurred (Article R. 631-3 of the French Consumer Code).
